The Picsart Design Challenge (the “Promotion”) is sponsored by PicsArt, Inc. (“PicsArt”). By participating in this Promotion or accepting a Prize (as defined below), you agree to these Promotion terms and conditions (the “Official Rules”).

This is a limited time offer. The Promotion is open and offered globally to users who are thirteen (13) years of age or older as of the date of entry who have an active Picsart user account (each an eligible “Participant”). Entrants under the age of 18 must have permission from their parents or legal guardians to participate.

How to Enter. To enter the Promotion follow all of the following steps to submit one (1) entry: (a) log on to the Picsart App and click on the Spaces Page; (b) Click on the Challenges banner at the top; (c) select a Challenge from the Challenges page (the “Challenge”); and (d) follow the steps within the Challenge to create your design and submit your edit (each a “Design”).

Design Guidelines: Designs must not contain any material that is: defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, endorsing political candidate, or otherwise objectionable. Picsart may disqualify and refuse to display any Design that violates these Official Rules, infringes on others’ rights, contains inappropriate content, or violates the Picsart Terms of Service. Picsart does not need to give notice before disqualifying Designs. Participants whose Designs are disqualified or removed will not receive compensation.

Limit three (3) entries per eligible Participant. Only three (3) Design submissions per Picsart user account are permitted. Entrants submitting more than 3 Design entries per Picsart user account or violating any of these Official Rules may be disqualified.

Limit one (1) Prize per eligible Participant. A Participant can only be awarded one (1) prize per Picsart user account regardless of number of Design submissions. If a Participant is selected as a winner of multiple prizes, the highest prize earned will be awarded (e.g. if a Participant Design qualifies for both a first place and second place prize, the First Place Finisher prize will be awarded, and if multiple Designs submitted from the same Picsart user account are eligible for second place, the Design with the most votes will be awarded the Second Place Showcase placement).

Winner Selection: All Promotion entries meeting the requirements of these Official Rules will be evaluated by Picsart, and will be publicly viewable for voting by Picsart users. Voting will be open for three days (the “Voting Period”). Each Picsart user will be able to cast one (1) vote per Design total during the Voting Period. Automated, scripted, macro, or multi-account voting is prohibited and will result in disqualification of associated votes. At the close of the Voting Period Picsart will tabulate all valid votes. The top winners will be selected by the Picsart community based on the greatest quantity of valid votes.

Prizes: The prizes to be awarded from the Promotion are displayed on the Promotion [challenge page].

Prizes: Total ARV of all prizes to be awarded: $15 (US). If the actual value of the prize is less than the stated ARV, the difference will not be awarded.

No cash or other substitution of prizes is permitted, except at the sole option of Picsart for a prize of equal or greater value. Prizes won by minors will be awarded to the parents or legal guardians, who must sign all required affidavits and releases. Picsart will not replace any lost or stolen prizes. Participants are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to prizes. You agree to provide Picsart with any additional information and complete any required tax or other forms relating to your receipt of a Prize. Allow eight (8) weeks for delivery of Prizes.

Notification of Winners: Winners will be notified by an in-app message or by email, at the email address provided or otherwise associated with the winner’s Picsart account, within ten (10) business days of vote tabulation, and may be required to sign and return an affidavit of eligibility and publicity/liability release within seven (7) days of notification. If a selected winner cannot be contacted, is ineligible, fails to claim a prize and/or where applicable an affidavit of eligibility and publicity/liability release is not timely received, is incomplete or modified, the prize may be forfeited and an alternate winner selected from remaining valid, eligible entries timely submitted. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the email account specified in the entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

By participating in this Promotion, you represent and warrant that you have obtained any appropriate or required approvals to participate in the Promotion and receive a Prize (e.g., from an employer), and your acceptance of the Prize is at your sole discretion. The Promotion is not open to: (1) employees and service providers of Picsart ; (2) the immediate family members or members of the same household of any such employees or service providers; (3) anyone professionally involved in the development or administration of the Promotion; (4) employees of government agencies and government-affiliated companies or organizations; or (5) any employee whose employer's guidelines or regulations do not allow participation in the Promotion or acceptance of the Prize.

Intellectual Property and Content Standards

(a) By submitting a design entry to the Challenge, you represent and warrant that: (a) you are the sole author and owner of the entry and all intellectual property rights therein, or you have obtained all necessary rights, licenses, consents and permissions to use and authorize Picsart to use the entry as set forth in these Rules; (b) your entry is original and does not infringe, violate or misappropriate the rights of any third party, including but not limited to any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; and (c) your entry complies with these Rules and all applicable laws and regulations.

(b) Picsart may remove any entry that violates these Official Rules, infringes on others’ rights, contains inappropriate content, violates the Picsart Terms of Service, or fails to meet contest requirements. Picsart does not need to give notice before removing entries. Participants whose entries are removed will not receive compensation.

Disclaimers and Limitations on Liability.

(a) Picsart is not responsible for (i) late, lost, delayed, damaged, postage-due, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by email or postal mail or otherwise; (ii) theft, destruction, unauthorized access to or alterations of entry materials; or (iii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.

(b) IN NO EVENT WILL PICSART BE LIABLE TO YOU FOR ANY SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE PROMOTION, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT PICSART HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Indemnification. You agree to release, indemnify, defend and hold Picsart and its parent, affiliates, subsidiaries, directors, officers, employees, sponsors and agents, including advertising and promotion agencies, and assigns, and any other organizations related to the Promotion, harmless, from any and all claims, injuries, damages, expenses or losses to person or property and/or liabilities of any nature that in any way arise from participation in this Promotion or acceptance or use of a prize or parts thereof, including, without limitation, (i) any condition caused by events beyond Picsart’s control that may cause the Promotion to be disrupted or corrupted; (ii) the prize, or acceptance, possession, or use of the prize, or from participation in the Promotion; (iii) any printing or typographical errors in any materials associated with the Promotion; and (iv) any claims arising from or related to intellectual property infringement, including copyright, trademark, patent, or other proprietary rights violations allegedly caused by your entry or participation.

Publicity: By entering, Participant grants Picsart a worldwide, royalty-free licence to use, reproduce, publish, modify, adapt, distribute and display the submitted Designs for promotional purposes, without additional compensation and, if applicable, to display their Picsart user account name in the Showcase.

Additional Considerations. Subject to applicable law, Picsart reserves the right to withdraw, vary, suspend or terminate this promotional offer (including amending these Official Rules) at any time, without notice. Picsart reserves the right to disqualify any entrant or winner, as determined by Picsart, in its sole discretion.

Governing Law and Choice of Forum. These Official Rules are governed by the law of the State of New York, without reference to rules governing choice of laws. Any action, suit or case arising out of, or in connection with, this Promotion or these Official Rules must be brought in either the federal and state courts located in New York County, New York.

Personal Information. Picsart may collect personal data about entrants online, in accordance with its privacy policy and as may be more specifically set forth in these Official Rules. Please review these Official Rules along Picsart’s privacy policy at https://picsart.com/privacy-policy/.

Winner’s List. For a list of prize winners, send an email message to support@picsart.com with “Picsart Design Challenge Winner” as the email subject. Requests must be received within four (4) weeks of the end of the Challenge Period. By participating in the Promotion, you acknowledge and agree to disclosure of your Picsart user account name as part of a list of prize winners.

Entire Agreement. These Official Rules constitute the entire and exclusive understanding and agreement between Picsart and you regarding the Promotion, and these Official Rules supersede and replace all prior oral or written understandings or agreements between Picsart and you regarding the Promotion. If any provision of these Official Rules is held invalid or unenforceable by an arbitrator or a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the other provisions of these Official Rules will remain in full force and effect.
